Terms of Use

These terms are a review-ready draft provided for transparency and should be confirmed by legal counsel before you rely on them.

1. Who we are

BookDinePlay (“the Service”) is operated by ThreeB IT GmbH, Bergstrang 105, 49479 Ibbenbüren, Germany (“BookDinePlay”, “we”, “us”). By creating an account, embedding our widgets, or otherwise using the Service, you (“the Customer”, a venue operator) agree to these Terms of Use.

2. The Service

BookDinePlay is a software-as-a-service platform that lets venues publish business information, menus, opening hours and bookable resources; take reservations for tables and game resources such as billiards and darts; optionally accept orders and online payments or deposits; and manage these through web and mobile tools and embeddable widgets. Features available to you depend on your subscription plan.

3. Accounts and eligibility

You must provide accurate registration details and are responsible for safeguarding your credentials and for all activity under your account. You must be authorised to act for the venue you register and be of legal age to enter into a contract.

4. Subscriptions, fees and billing

Paid plans are billed in advance on a monthly or annual basis in euro (EUR). Annual plans are billed once for twelve months at the equivalent of ten months. Fees are exclusive of applicable taxes unless stated. Unless required by law, payments are non-refundable. You may cancel at any time; access continues until the end of the paid period. We may change plan pricing with reasonable prior notice effective at your next renewal.

5. Payments and deposits (optional)

Where you enable online payments or deposits, payment processing is provided by a third-party processor (e.g. Stripe) under its own terms. BookDinePlay does not store full card details. When you collect money from guests through the Service, BookDinePlay may deduct a platform fee and the payment processor’s fees, remitting the remainder to you. You are responsible for fulfilling orders and honouring reservations and deposits, and for any refunds or chargebacks arising from your venue.

6. Guest data and your responsibilities

Guest personal data you collect through the Service is processed by us on your behalf as a processor; you are the controller for that data. You must have a lawful basis to collect it, provide guests with required information, and use the Service in compliance with applicable law, including consumer-protection, food-safety and data-protection rules. You are responsible for the accuracy of your menus, prices, availability and opening hours.

7. Acceptable use

You may not misuse the Service, including by attempting to breach security, disrupt the platform, scrape data, infringe intellectual-property or third-party rights, or use it for unlawful, misleading or harmful content. We may suspend accounts that put the Service, other customers, or guests at risk.

8. Intellectual property

The Service, including its software, design and trademarks, belongs to ThreeB IT GmbH. We grant you a non-exclusive, non-transferable right to use the Service during your subscription. You retain ownership of your own content (menus, images, venue data) and grant us the rights needed to host and display it to operate the Service.

9. Availability and support

We aim for high availability but do not guarantee uninterrupted service. Maintenance, updates and factors outside our control may cause downtime. Support levels may vary by plan.

10. Liability

To the extent permitted by law, the Service is provided “as is”. We are liable without limitation for intent and gross negligence and under mandatory statutory liability (including the German Product Liability Act and for injury to life, body or health). For slight negligence we are liable only for breach of essential contractual obligations, limited to foreseeable, typical damage. Any further liability is excluded.

11. Term and termination

The agreement runs for your chosen billing period and renews unless cancelled. Either party may terminate for good cause. On termination you may export your data for a reasonable period, after which we may delete it in line with our Privacy Policy and legal retention duties.

12. Changes

We may update these terms; material changes will be communicated with reasonable notice and take effect at your next renewal or as stated in the notice.

13. Governing law and venue

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Where permitted, the place of jurisdiction is the registered seat of ThreeB IT GmbH. Mandatory consumer-protection provisions of the country in which a consumer guest resides remain unaffected.
